Road Accident? injured? claim today

Can I actually make a claim for my road traffic injury?

Whether or not you as an individual can make a claim for financial compensation will depend on the circumstances surrounding your accident. If the matter has been deemed sufficiently severe to warrant police involvement, then this will be a criminal matter and cannot be pursued in the civil courts.

However if your injury has not been the subject of police involvement, it is very probable that it could be pursued as a personal injury action. If you have been injured in a road traffic accident that was not your fault, you can seek to be awarded compensation for this.

What does making a road traffic injury claim in Leeds involve?

Making a personal injury claim following a road traffic accident requires that a certain set of rules are followed. The Accident Claimline includes expert personal injury lawyers that are regularly involved in pursuing claims under these rules. They will use their considerable expertise to pursue the maximum level of compensation for you.

Bringing a claim for compensation under personal injury laws requires that two things can be demonstrated:

1.  First, you will need to be able to show that the individual that caused you to suffer your injury had an obligation not to take any form of action that could expose you to the risk of injury.  This is otherwise known as their duty of care in law.

It doesnt matter whether you were involved in an accident involving a car, bus, taxi or bicycle. All UK road users are expected to conduct themselves in such a way that does not expose other road users to the risk of harm. Another important point is that road users not only owe this obligation to other drivers, but also to other passengers in vehicles and pedestrians.

2.   The next, and arguably more important, point that needs to be proved is that in having suffered injury, the duty of care that you were owed had not been observed.

This is the most important part of a compensation claim: you will need to be able to set out how a road user actually caused your injury. This involves you setting out how their negligence caused you to suffer harm.

The success or failure of a personal injury claim that develops out of a road traffic accident will almost always hinge on the quality of the evidence available. A court will not easily award compensation unless negligence is clearly demonstrated, and this negligence is proven to have caused your injury.  In working with us, it is very important that you take the time to provide us with as much information surrounding your accident and injury as possible. At the Accident Claimline, we will pursue the maximum level of compensation that is available in the circumstances, but this is only likely to result in a successful claim if the quality of the evidence is convincing.

Helpful evidence includes:

  • photographs of your road traffic accident;
  • statements from people who witnessed the accident;
  • details of the impact the road traffic accident has had on you; and
  • any paperwork that demonstrates the severity of your injury.

We will be able to use this information to enhance the strength of your claim, which will then increase the likelihood of a successful compensation claim.

How much money will I get?

It is very difficult to spell out exactly how much someone will be likely to be awarded in the event of a successful personal injury claim: the actual value will depend on the circumstances surrounding your injury, and the severity of the injury that you suffered. Not only this, but where you suffered injury can also play an important role in determining how much compensation you can expect.

UK law attaches different monetary value to different parts of the body. If you have suffered injury to a particularly important part of the body, e.g. the head which houses our brain, then you may be able to pursue a particularly high sum of money. Alternatively, damage to the limbs will also attract a certain sum, but this will again depend on the severity of the injury.

It is also very important to remember that there are different kinds of compensation that you can be entitled to. While in most instances your claim will include a claim that reflects the level of pain that you have suffered, your claim can also include the following:

  • the cost of any personal care that you have had to arrange as a result of your injury;
  • any loss of income that your injury has caused you to endure; and
  • any costs incurred in having an injury treated by a healthcare professional.
