Head & Brain Injury Compensation

The head and brain injury compensation guidelines are split into 5 sections:

  • Very Severe Brain Damage
  • Moderately Severe Brain Damage
  • Moderate Brain Damage
  • Less Severe Brain Damage
  • Minor Brain or Head Injury

The guidelines in this section are primarily linked with injuries that produce physiological dysfunction of the brain. There are separate guidelines for a Psychiatric injury however diagnosed cases of Post Concussional Syndrome (PCS) following a head injury can also be considered within this section.

The common symptoms of diagnosed PCS include:

  • Headaches
  • Dizziness
  • Nausea

Very Severe Brain Damage injury guidelines range from £214,350 to £307,000. Examples of this would include brain damage causing just some ability to follow basic commands, little or no speech, double incontinence and the need for full time care. The level of the award within this range relates to the degree of insight the injured person has, life expectancy and the extent of physical limitations.

Moderately Severe Brain Damage injury guidelines range from £166,500 to £214,350. Examples of this would be the injured person being very seriously disabled and have dependence on others around them. This may also include where other severe medical problems are a risk in the future such as blindness. The level of the award in this range relates to the degree of insight the injured person has, life expectancy, behaviour, ability to talk and communicate, dependence on others and extent of physical limitations.

Moderate Brain Damage injury guidelines are again split into 3 sections:

£114,100 to £166,500 - these are cases where there is moderate to severe intellectual deficit, changes in personality and effects on sight, speech and senses. This also includes no prospect of future employment.

£69,000 to £114,100 - these are cases where there is moderate to modest intellectual deficit, the prospects of future employment are greatly reduced and there may be risk of future epilepsy.

£32,725 to £69,000 - these are cases where memory and concentration are affected, future employment and work is reduced and there is a small risk of future epilepsy.

Less Severe Brain Damage injury guidelines range from £11,650 to £32,700. Examples for this section is that the injuried person will have made a good recovery and be able to return to a normal work and social life after the accident. There may be some affects such as poor concentration and memory. The level of award in this section depends on the extent and severity of the injury, the extent of disability, the extent of any personality change and depression.

Minor Brain or Head Injury guidelines range from £1,675 to £9,700. In these cases brain damage (if any) will be minimal. The level of award in this section depends on severity of initial injury, recovery period, extent of ongoing symptoms and headaches.
